Not The Way America Is Supposed To Work


The concept of Sanctuary Cities seems alive in well in America today - and has been so for some time now. The very first recorded Sanctuary City was Los Angeles in 1979.

For those who, for whatever reason, do not know what a Sanctuary City is, the following definition may help:

"Any city, town or municipality whose management (i.e., mayor, city council, commissioner, etc), with or without the acceptance and/or support of its citizenry, chooses not to enforce 8 U.S. Code 1325 - That is, chooses not to enforce the Federal law against illegal aliens thereby creating a "no-prosecution zone" for those in our country illegally."

Curiously, there is a Federal Law against the allowing of illegal immigration, including the harboring and/or supporting the concealment of illegal aliens. It is 8 U.S. Code 1324. And, it proscribes lengthy jail time for violation.

The President-Elect, Donald Trump, as part of his campaign for the presidency made dealing with the issue of illegal immigration a top priority. Many have railed against him for his stance.

In case some do not realize, the president swears an oath upon taking office: "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States." This oath is meant, of course, to include upholding the Nation's laws.

Since Trump's election several prominent mayors and municipality officials have publicly stated that they will refuse to implement any order to follow 8 U.S. Code 1324.

Here are but a few of our major cities stating such: Los Angeles, Seattle, New York City, San Francisco, Philadelphia and, of course, Chicago. Here is a picture of the full list of such cities known to date:

Now, it has been asserted by reported representatives of the President-Elect that certain Federal funds will be withdrawn from any municipality refusing to follow Federal Law, specifically with regard to 8 U.S. Code 1324. Such withholding of funds is perfectly within the powers and rights of a US president - or so it may be argued. (See "II The Power To Execute The Laws And Power To Impound" within this link). And, of course, any impacted municipality could bring suit to seek relief. Who knows how long that might take to resolve.

Additionally, some have argued that in certain circumstances States may not adhere to Federal Law - most often unsuccessfully. But, there is no existing opinion allowing cities or other "local" municipalities such leeway.

But, in this whole concept of withholding funds, something is missing.

Those who would be most negatively affected by removal of funds would NOT be the perpetrators of violation of 8 U.S. Code 1324. It would be the innocent people under such municipality leadership(s) who rely on those same Federal funds..

I would suggest that such responsible municipality leaders be charged with the crimes they are committing and judged accordingly. 10 years in a Federal prison may change their views on upholding our Nation's laws.

At this point in time are we not tired of politicians who believe they are above the law, act on that belief, and get away with it?

In America, the way it is supposed to work, if a law is felt to be unfair, wrong, or otherwise undesirable, we as a people endeavor to change the law - not ignore it or act as though it applies to all but ourselves.
